Do I have to attend an interview under caution?
In most cases, attendance is voluntary, but refusing to attend could lead to the police or authority deciding to arrest you instead.
It is always best to take legal advice before deciding whether to attend.

Should I have a solicitor with me?
Yes. You should always have legal representation at an interview under caution.
A solicitor will ensure that you understand the process, explain your rights, and advise you on whether to answer questions, give a prepared statement, or remain silent.
Having a solicitor present helps to prevent misunderstandings and protects you from saying something that could harm your case later.
Do I have to pay for a solicitor at the interview?
No. Legal representation at a police station or during an interview under caution is free of charge under the Legal Aid scheme, regardless of your income or personal circumstances.
You are entitled to request Morton’s Solicitors specifically, and we can attend the interview with you anywhere in Greater Manchester or the North West.
What happens during the interview?
The interviewer will explain the allegation and ask you questions about your involvement. The interview is audio-recorded, and you will be given the formal caution at the start.
You have the right to stop the interview at any point to speak privately with your solicitor. Once it concludes, the investigating officer will decide what action to take next.
What could happen after the interview?
After an interview under caution, the investigating authority may:
- Take no further action and close the case.
- Issue a warning, caution or penalty notice.
- Refer the case to the Crown Prosecution Service (CPS) or equivalent body for a charging decision.
